Terms and Conditions

Introduction:

These Terms and Conditions (“Agreement”) govern the provision of services by the Buyer’s Agent (“Agent”) to the client (“Buyer”). By engaging the Agent’s services, the Buyer agrees to the terms set forth below.

Scope of Services:

The Agent agrees to provide the following services to the Buyer:

  1. Identify properties that meet the Buyer’s criteria
  2. Arrange property viewings
  3. Negotiate the purchase price and other terms on behalf of the Buyer
  4. Provide guidance on the home buying process, including but not limited to, financing, inspection, and closing procedures.

Fees:

The Agent’s fee for services is ______% of the purchase price of any property acquired through the Agent’s services. This fee is due upon the successful completion of a transaction.

Confidentiality:

The Agent agrees to maintain the confidentiality of all information provided by the Buyer and not to disclose such information to any third party without the Buyer’s consent, except as required by law.

Duties and Obligations:

The Agent will use reasonable skill, care, and diligence in the performance of its duties under this Agreement. However, the Agent shall not be liable for any loss or damage suffered by the Buyer as a result of the Buyer’s failure to follow the Agent’s advice or instructions.

The Buyer agrees to provide the Agent with accurate and complete information regarding the Buyer’s property preferences and financial situation. The Buyer also agrees to promptly inform the Agent of any changes in the Buyer’s circumstances that may affect the Agent’s services.

Termination:

Either party may terminate this Agreement at any time by giving written notice to the other party. If the Buyer terminates the Agreement, the Agent shall be entitled to receive its fee for any transaction that is completed within 90 days of the termination.

Limitation of Liability:

The Agent shall not be liable to the Buyer for any loss or damage arising from the Agent’s services except in the case of fraud or willful misconduct.

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the state/province in which the Agent is located. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of that state/province.

Entire Agreement:

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.

Amendments:

This Agreement may only be amended in writing and signed by both parties.

By signing below, the parties acknowledge that they have read and understood this Agreement and agree to be bound by its terms and conditions.
